JUDGE TO "OBAMA DETENTION OF U.S. CITIZENS" PLAN - NO WAY!

A district-court judge has suspended enforcement of a law that could strip U.S. citizens of their civil rights and allow indefinite detention of individuals President Obama believes to be in support of terror.

The Obama administration has refused to ensure that the First Amendment rights of authors and writers who express contrary positions or report on terror group activities are protected under his new National Defense Authorization Act.

Targeted in the stunning ruling from U.S. District Judge Katherine B. Forrest of New York was Paragraph 1021 of the NDAA, which Obama signed into law last Dec. 31. The vague provision appears to allow for the suspension of civil rights for, and indefinite detention of, those individuals targeted by the president as being in support of terror.

Virginia already has passed a law that states it will not cooperate with such detentions, and several local jurisdictions have done the same. Arizona, Rhode Island, Maryland, Oklahoma, Tennessee and Washington also have reviewed such plans.

The case was before Forrest on a request for a temporary restraining order. The case was brought on behalf of Christopher Hedges, Daniel Ellsberg, Jennifer Bolen, Noam Chomsky, Alex O’Brien, Kai Warg All, Brigitta Jonsottir and the group U.S. Day of Rage. Many of the plaintiffs are authors or reporters who stated that the threat of indefinite detention by the U.S. military already had altered their activities.

Constitutional expert Herb Titus filed a friend-of-the-court brief on behalf of the sponsor of the Virginia law, Delegate Bob Marshall, and others.

Titus, an attorney with William J. Olson, P.C., told WND that the judge’s decision to grant a preliminary injunction halting enforcement of paragraph 1021 “affirms the constitutional position taken by Delegate Marshall is correct.”

The impact is that “the statute does not have sufficient constitutional guidelines to govern the discretion of the president in making a decision whether to hold someone in indefinite military detention,” Titus said.

The judge noted that the law doesn’t have a requirement that there be any knowledge that an act is prohibited before a detention, he said. The judge also said the law is vague, and she appeared to be disturbed that the administration lawyers refused to answer her questions.

The opinion underscores “the arrogance of the current regime, in that they will not answer questions that they ought to answer to a judge because they don’t think they have to,” Titus said.

The judge explained that the plaintiffs alleged paragraph 1021 is “constitutionally infirm, violating both their free speech and associational rights guaranteed by the 1st Amendment as well due process rights guaranteed by the 5th Amendment.”

She noted the government “did not call any witnesses, submit any documentary evidence or file any declarations.”

“It must be said that it would have been a rather simple matter for the government to have stated that as to these plaintiffs and the conduct as to which they would testify, that [paragraph] 1021 did not and would not apply, if indeed it did or would not,” she wrote.

Instead, the administration only responded with, “I’m not authorized to make specific representations regarding specific people.”

“The court’s attempt to avoid having to deal with the constitutional aspects of the challenge was by providing the government with prompt notice in the form of declarations and depositions of the … conduct in which plaintiffs are involved and which they claim places them in fear of military detention,” she wrote.

“To put it bluntly, to eliminate these plaintiffs’ standing simply by representing that their conduct does not fall within the scope of 1021 would have been simple. The government chose not to do so – thereby ensuring standing and requiring this court to reach the merits of the instant motion.

“Plaintiffs have stated a more than plausible claim that the statute inappropriately encroaches on their rights under the 1st Amendment,” she wrote.

Forrest found that the plaintiffs had a reasonable fear of detention based on the language of the statute. She ordered the provision not to be enforced until further proceedings in her court or “remedial” action by Congress that would restore those protections.

During a hearing, Hedges, a longtime international reporter, testified that in connection with his reporting he interviewed members of Hamas, met with leadership and even stayed in their homes.

The brief was on behalf of Marshall and other individuals and organizations including the United States Justice Foundation, Downsize DC Foundation, Institute on the Constitution, Gun Owners of America, Western Center for Journalism, the Tenth Amendment Center and Pastor Chuck Baldwin.

“The government was given a number of opportunities at the hearing and in its briefs to state unambiguously that the type of expressive and associational activities engaged in by plaintiffs – or others – are not within [paragraph] 1021. It did not. This court therefore must credit the chilling impact on 1st Amendment rights as reasonable – and real,” Forrest said.

Marshall’s HB1160 passed the Virginia House of Delegates by a vote of 87-7 and the Virginia Senate 36-1. Since the vote was on changes recommended by Gov. Bob McDonnell, it was scheduled to take effect without further vote.

Marshall then wrote leaders in state legislatures around the country suggesting similar votes in their states.

Marshall’s letter noted Virginia was the first state in the nation to refuse cooperation “with federal authorities who, acting under the authority of section 1021 of the National Defense Authorization Act of 2012 (NDAA), could arrest and detain American citizens suspected of aiding terrorists without probable cause, without the right to know the charges against them, and without the procedural rights guaranteed by the Bill of Rights. Our new law goes into effect on July 1, 2012.”

He told lawmakers, “While we would hope that the U.S. Senate and U.S. House of Representatives would be vigilant to protect the constitutional rights of American citizens, even when addressing the problem of international terrorism, those efforts in Congress failed at the end of last year, and President Obama signed NDAA into law on December 31, 2011.”

Endorsing Marshall’s plan was the Japanese American Citizens League, which cited the detention of tens of thousands of Japanese Americans during World War II on no authorization other than the president’s signature.

Titus said in adopting the law, McDonnell “would fulfill the historic role of the states as being guardians of the people from usurpations of authority from the central government.”

OBAMA ON RECORD AS KENYAN BORN AS LATE AS 2007!

I got back home yesterday evening just after 6 pm after a busy day at work from the Western Center for Journalism. Usually, the first thing I do when I get home is to turn on my computer and check my personal e-mail (I subscribe to a lot of libertarian/conservative website newsletters/alerts.)

Miriam Goderich edited the text of the bio; she is now a partner at the Dystel & Goderich agency, which lists Obama as one of its current clients.

“This was nothing more than a fact checking error by me–an agency assistant at the time,” Goderich wrote in an emailed statement to Yahoo News.

“There was never any information given to us by Obama in any of his correspondence or other communications suggesting in any way that he was born in Kenya and not Hawaii. I hope you can communicate to your readers that this was a simple mistake and nothing more.”

I have two questions:

1. The Yahoo article was written approximately four hours after the Breitbart.com article was published. How could Ms. Goderich have possibly prepared her statement, much less heard about Breitbart’s piece so quickly, unless someone (say from Obama’s regime, I mean administration) threatened her or her agency?

2. How could she possibly become president of a literary agency if she displayed such enormous incompetence early in her career? Come on!!! It just doesn’t add up.

While reading the entire blog post, one who has carefully followed ForgeryGate from the beginning will immediately see how the author (Dylan Stableford) and Ms. Goderich are full of it. I challenge you to check out the link to the Yahoo story earlier in this post and NOT feel this way.

As an investigative journalist in the making, I went to the “About Us” page on this literary agency’s website and sent a separate e-mail to each of the nine head staff members whose e-mail addresses were provided, asking for a comment on this groundbreaking story.

I did not hear from a single one of them. Of course, Ms. Goderich goes and releases a “statement” to Yahoo News. What, were they all hiding underneath their desks, scared of what Obama would do to them should they open their mouth?

At the end of the day, the response by the mainstream media in this manner is a good thing, as I believe it shows that they are getting desperate to hide the gruesome truth that the current occupant of the White House is a complete fraud. They know that there is only so much time left until the whole world knows about the true Barack Hussein Obama.

While some quickly dismissed as an anomaly yesterday’s explosive revelation that Barack Obama’s former literary agency billed him as “born in Kenya” back in 1991 in connection with a book he never wrote, WND has discovered much later published references – some dated as recently as 2007 – used to promote his highly touted book “Dreams from My Father.”

As WND reported, Breitbart News originally found a brochure from two decades ago in which literary agency Acton & Dystel promoted Obama as the author of the never-produced “Journeys in Black and White” by declaring Obama was “born in Kenya and raised in Indonesia and Hawaii.”

Twelve years later, however, the Dystel of Acton & Dystel was busy promoting Obama’s new book, “Dreams from My Father,” and still touting the author as “born in Kenya.”

Through the Internet archive Wayback Machine, WND found an August 2003 listing of Dystel & Goderich’s author bios, including the following: “Barack Obama was the first black president of the Harvard Law Review. He was born in Kenya to an American anthropologist and a Kenyan finance minister, and was raised in Indonesia, Hawaii and Chicago. His first book is ‘Dreams from My Father: A Story of Race and Inheritance.”

But the Turkish Islamist regime, which Obama put in charge of forming the SNC, put the Muslim Brotherhood in control, a fact I pointed out within hours of the announcement of the SNC leadership’s names.

Now that several SNC leaders have resigned complaining about Brotherhood domination, followed by some Arab journalists pointing out the obvious Brotherhood domination at the SNC’s last meeting, that reality is clear.

But the implications of such an incredibly foolish policy—America putting an anti-American, antisemitic group into the “official” leadership of Syria’s rebels — have never been properly examined as a case study for Obama’s disastrous Middle East policy.

The Kurds had walked out of the talks that formed the SNC last year when they saw how Islamists would be in control. Not only do they oppose Islamism itself but they also see the Brotherhood as an Arabizing and centralizing group that would impose a regime oppressing the non-Arab Kurds.

The new U.S. effort so backfired that, with the Obama administration ignoring their concerns, the enraged Kurds in the delegation spoke for the first time of breaking up Syria altogether!

To sum up, Obama policy has strengthened the Islamist forces in the opposition and fragmented the rebels, thus helping preserve a radical anti-American Syrian regime that is an ally of Iran or helping make any revolution more likely to produce a radical anti-American Syrian Islamist regime that will be an ally of an Islamist Egypt.

Now comes a very peculiar story in the Washington Post with the headline, “Syrian rebels get influx of arms with Gulf Neighbors’ Money, U.S. coordination.”

Let’s break this down logically:

–The Saudis and Qataris have been providing arms already. (Needing no U.S. coordination)

–They know how to buy weapons, how to get them to the Syrian border, and how to give them to Syrian rebels.

What do they need American “coordination” for?

What does the word “coordination” mean? I presume it means that the Obama administration, absolutely clueless about what to do regarding Syria, simply wants to take credit for others’ actions. 

It is part of the pre-election spin about what a great job Obama is doing.

Yet there is another problem here, a potentially devastating one. Who is getting the weapons? 

There are different people and groups in the Syrian opposition.

Some are Salafists who feel comfortable with al-Qaida;
some are Brotherhood men;
some are ex-Syrian army officers, professionals and relatively apolitical;
and some are liberals who really want democracy.

Whoever gets these weapons will be tremendously empowered. So what’s to say that the arms being “coordinated” by the United States aren’t going to revolutionary Islamists? 

While this is a complex subject, there is information that these arms supplies up until now have not been sufficiently discriminatory toward moderates and and directed toward radical Islamists. We will know more in the weeks to come if we can see and identify which opposition groups in what parts of Syria have become better armed.

And if it comes out that the U.S. government is “coordinating” the arming of such people with weapons — as it is already helping their political counterparts in the SNC — wouldn’t that be a tremendous scandal?

Let’s be clear here: A proper U.S. policy would help moderate Syrians overthrow the Assad dictatorship and make sure weapons went to the best elements in the Free Syrian Army’s decentralized forces.

Such a policy would make sure to deny money, weapons, and power to the Islamists and Salafists, who are proportionately far weaker in Syria than in Egypt.

Obama policy follows the worst possible course. It minimizes U.S. help to the revolution while at the same time ensuring that a disproportionately large amount goes to Islamists.

Air Force Two (which costs $11,351per hour to operate according to Government Accounting Office reports) only used 47,500 gallons of jet fuel for this trip and carbon emissions were a mere 1,031 tons of CO2. These are only rough estimates, but they are close. That's quite a carbon footprint as my good friend Al Gore would say, so we must ask the American citizens to drive smaller, more fuel efficient cars and drive less too, so we can lessen our combined carbon footprint. I know times are hard and millions of you are struggling to put food on the table and trying to make ends meet. So I do appreciate your sacrifices and do hope you find work soon.
